Terms of Use

1. Acceptance of Terms

Doxlair is a product and brand owned and operated by Alcon CRS, LLC. In these Terms, "Doxlair," "we," or "us" refers to Alcon CRS, LLC. By accessing or using the Doxlair platform ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including organization administrators and invited team members.

2. Description of Service

Doxlair provides a cloud-based software platform for construction trade companies to manage change orders, field reports, project scheduling, photo documentation, and related project management workflows. Features vary by subscription plan.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration.

4. Subscription Plans, Payment, and Plan Changes

Doxlair offers multiple subscription tiers. Paid plans are billed monthly or annually as selected. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.

Upgrades

When you upgrade your plan mid-billing period, a prorated charge for the remaining days in your current period at the new plan's rate is invoiced and charged to your payment method immediately. Your upgraded features and limits activate at the time of confirmation.

Downgrades & No Refunds

All fees paid are non-refundable except as required by applicable law. Downgrading your plan does not entitle you to any refund or credit — monetary or otherwise — for any unused portion of the current billing period. The remaining days on your current plan are forfeited upon downgrade with no compensation. Your new lower plan limits take effect immediately upon downgrade confirmation.

Cancellations

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial-period refunds are issued upon cancellation.

5. Acceptable Use

You agree not to use the Service to:

• Upload malicious files, viruses, or any code designed to disrupt the Service
• Attempt to gain unauthorized access to any systems or data
• Violate any applicable laws or regulations
• Misrepresent your identity or organizational affiliation
• Reverse engineer, decompile, or otherwise attempt to extract source code

6. Intellectual Property

The Doxlair platform, including its design, software, and branding, is owned by Alcon CRS, LLC and protected by intellectual property laws. Doxlair is a product and brand operated by Alcon CRS, LLC. You retain ownership of all project data and content you upload. By using the Service, you grant Alcon CRS, LLC a limited license to process your data solely to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. SMS Messaging Terms

Alcon CRS, LLC, doing business as Doxlair, offers an optional transactional SMS program. If you enter a mobile number and affirmatively check the unchecked SMS consent box in Doxlair settings, you consent to receive six-digit phone verification codes that you request and secure Daily Interview links. Links may be sent when an authorized account administrator requests one or enables a workday schedule for the assigned Project Manager. Enrollment is optional and is not required to purchase or use other Doxlair features.

• Message frequency varies based on your requests and use of the Service.
• Message and data rates may apply.
• Reply STOP to opt out and HELP for help.
• You may also withdraw consent in your Doxlair SMS settings.
• Consent to SMS is not a condition of purchase.
• Carriers are not responsible for delayed or undelivered messages.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. Doxlair does not warrant that the Service will be error-free or uninterrupted. To the fullest extent permitted by law, Doxlair's liability to you for any claims arising from these Terms shall not exceed the amounts you paid in the 12 months preceding the claim.

10. Termination

Either party may terminate access to the Service at any time. Doxlair may suspend or terminate your account immediately for material violations of these Terms. Upon termination, your right to use the Service ceases and your data will be handled per our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
